Stop Anti-Boycott Legislation In Arizona

An anti-boycott bill has been introduced in the Arizona House of Representatives after being passed in the Arizona Senate. Numbered SB 1167, the bill seeks to require companies who contract with Arizona public entities to certify that the company “is not currently engaged in, and agrees for the duration of the contract not to engage in” a boycott of Israel. The bill is a resurrection of HB 2617, a 2016 Arizona House bill which was blocked from being enforced by the U.S. District Court for Arizona due to violations of free expression.

Boycotts have been instrumental in effecting positive social change throughout American history and should remain a viable option for non-violent social justice movements. Inspired by the South African anti-apartheid movement, 170 Palestinian civil society organizations called for boycotts, divestment and sanctions (BDS) as a form of non-violent pressure on Israel back in 2005. Regardless of whether one agrees with their tactics or political aim, there is no question about the constitutionality of US citizens choosing to support it.

SB 1167 is a bill which ultimately seeks to prohibit and restrict the free expression of millions of Arizonans despite being a clear violation of the First Amendment of the U.S. Constitution.
